These Terms of Service ("Terms") govern your access on usage of our services ("Services"), including email notifications, apps, APIs, commerce services (payments and refunds, etc), ads and any information, text, photos, graphics, links, videos, or any other uploaded/downloada/appearing material on the Services (collectively, "Content"). By using the Services you agree to be bound by these Terms.
You may use our Services only if you agree to form a binding contract with the Synex company and if you're not limited to receive services under the laws of the applicable jurisdiction. You must be at least 13 years old to use our Services. If you are accepting these Terms and using the Services on behalf of a legal entity (company, organization, government, etc.), you represent and warrant that you are authorized to do so.
Our Privacy Policy (https://www.synextechnologies.com/privacy.php) describes how we handle the information you provide to us when you use our Services. You understand that through your use of the Services you consent to the collection and use (as defined in the Privacy Policy) of this information, including the transfer of this information to other countries for storage, processing and use by Synex Company and its affiliates.
The responsibility for usage of our Services, including compliance with applicable laws, rules and regulations, lies entirely on you. We do not support, represent or guarantee the completeness, accuracy, truthfulness or reliability of any Content provided by the Services (especially for data acquired from the 3rd party). We don't condone the usage of the data provided by our services for any malicious activity. Responsibility for the content we do not provide directly, lies entirely on the content owner or 3rd party service. At our sole discretion, we reserve the right to remove any Content from our services without prior notice and without liability to you
You have a right to ask for account deletion by directly sending an email request to support@synextehnologies.com, in which case all data and previously acquired services are lost. Deletion proces might take up to 14 days to complete. All active payments and subscriptions are forfeit. Uppon receiving account deletion request, we are in no obligation to issue a refund (for inactive or active services) or restore any of the deleted data. You can ask for a refund within 48 hrs from the time of the purchase and exclusively if the purchase goods is refundable. The good/service is refundable if there is no chance of further service utilisation or distribution of previously acquired products to a 3rd parties uppon service termination or issued refund. Decision on wether a service is refundable lies completely on our support staff to determine and any decision they make is final. Simple example would be a purchased and downloaded data set (non-refundable) vs in service "credits" (refundable).
Synex Technologies provides a license with the sole purpose of enabling you to use and enjoy the benefits of the Services provided by our company, in the manner permitted by these Terms. Services are protected by trademark, copyright and other laws on both US and foreign countries. Nothing in the Terms gives you the right to use any of Synex tradmearks, logos or any other distinctive brand features. Any comment, feedback or suggestions you may provide in regard to Synex Technologies or Services is entirely voluntary and we will be free to use such details as we see fit and without any obligation to you.
In order to use some of our services, you might be required to create an account and/or provide appropriate permissions to your exising 3rd party services (e.g. social networks). You are responsible for the safety of your account, so use strong passwords and limit the access to it. We cannot and will not be liable for any loss or damage arising from your failure to comply with the above. We may use your details (e.g. Email) in order to provide appropriate notifications, related but not limited to our services and their usage. Some of those you might be able to opt-out via profile settings, others might be mandatory. By accepting this Terms you agree to receive notifications from our Services.
In order to end these Terms, you are obligated to send an account deletion request. We may suspend or terminate your account or cease to provide you the Services (partially or fully) at any time for any or no reason, including but not limtied the belief: (1) you violated these Terms; (2) you create risk or possible legal exposure for us; (3) your account should be removed due to prolonged inactivity; (4) our provision of Services to you is no longer commercially viable. We will make reasonable efforts to notify you either by email address associated with your account or with your next attempt to access your account (depending on the circumstances). In all such cases the Terms will be terminated along with the license to use our Services in general.
Your access and usage of the Services is at your own risk. Services are provided on "as is" and "as available" basis. Synex company makes no warranty or representation and siclaim all responsibility and liability for: (1) completness, accuracy, availability, timeliness, security or reliability of the Services or any Content it might provide; (2) any harm to your computer system, loss of data or other harm that results from your access to or use of the Services or any Content; (3) the deletion or failure to store or transmit any Content and other communications maintainted by the Services; (4) weather the Services will meet your requirements or be available on an uninterrupted, secure or error-free basis. No advice or information, whether oral or written, obtained from Synex Company entities or through the Services, will create any warranty or representation not expressly made herein.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SYNEX COMPANY ENTITIES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOOD-WILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (i) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (ii) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES, INCLUDING WITHOUT LIMITATION, ANY DEFAMATORY, OFFENSIVE OR ILLEGAL CONDUCT OF OTHER USERS OR THIRD PARTIES; (iii) ANY CONTENT OBTAINED FROM THE SERVICES; OR (iv) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT. IN NO EVENT SHALL THE AGGREGATE LIABILITY OF THE SYNEX COMPANY ENTITIES EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS (U.S. $100.00) OR THE AMOUNT YOU PAID TO SYNEX COMPANY, IF ANY, IN THE PAST SIX MONTHS FOR THE SERVICES GIVING RISE TO THE CLAIM. THE LIMITATIONS OF THIS SUBSECTION SHALL APPLY TO ANY THEORY OF LIABILITY, WHETHER BASED ON WARRANTY, CONTRACT, STATUTE, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, AND WHETHER OR NOT THE SYNEX COMPANY ENTITIES HAVE BEEN INFORMED OF THE POSSIBILITY OF ANY SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.
We reserve the right to update or change our Terms of services at any time. Changes will not be retroactive and the most up-to-date version will govern our relationship with you. We will try to notify on any Terms alterations, either via email address you provided or via service norifications. By continuing to acccess or use the Services after those revisions become effective, you are agreeing to be bound by the revised Terms.
